Why Do I Need a Building Safety Case?
The Technical Bit
A Building Safety Case addresses the legal requirements introduced by the Building Safety Act 2022. It is a structured set of information that demonstrates how building safety risks, particularly those related to fire spread and structural integrity, are being identified, managed, and mitigated over time. Accountable Persons and Principal Accountable Persons are required to maintain a comprehensive Safety Case Report for higher-risk residential buildings (HRBs), and submit it to the Building Safety Regulator upon request.
Communal areas in multi-occupied residential buildings fall within the scope of the legislation, meaning that those responsible must demonstrate ongoing compliance and ensure the building is safe for residents throughout its lifecycle.
Worth Knowing:
The observations, findings, and recommendations within a Building Safety Case are based on the evidence available at the time of assessment and must be regularly updated to reflect any changes in risk.
Building Safety Cases are not a one-off exercise, they must be reviewed and revised on an ongoing basis. The frequency of review should reflect the risk profile of the building, as well as the robustness of the safety management arrangements in place.
A Building Safety Case Report should include a clear narrative that links evidence to conclusions about building safety, including whether current controls are sufficient to manage identified risks.
The quality of the Safety Case depends on the availability of accurate data, access to the building, and cooperation from those managing the property.
Recommendations and conclusions should be supported by evidence, assumptions without substantiation will not meet regulatory expectations.
Safety Case Reports are prepared with reference to legislation, guidance documents, and approved methodologies; however, legal interpretation ultimately rests with the courts and the Building Safety Regulator.
What To Do…
Ensure that a Building Safety Case is compiled and maintained for all in-scope buildings, and that it is reviewed and kept up to date ‘Regularly’ in line with legal expectations.
Ensure that the Building Safety Case is developed by a competent and impartial party with demonstrable expertise in building safety and risk management.
Ensure that all identified risks and actions are prioritised and tracked to resolution, and that this is clearly documented within the Safety Case Report.
Where possible, integrate relevant assessments—such as Fire Risk Assessments and structural inspections—into the Building Safety Case to avoid duplication, streamline oversight, and support cost-effective compliance.
